Terms and conditions

TERMS & CONDITIONS

Property People Partners is a trading name of Our Village Homes Ltd, a company registered in England and Wales under company number 16878019.

These Terms & Conditions set out the basis on which Property People Partners provides recruitment, executive search and property consultancy services.

By engaging Property People Partners, you agree to these Terms & Conditions.

1. OUR SERVICES

Property People Partners provides recruitment, executive search and property consultancy services primarily to businesses operating within the property sector, including:

  • Property law firms
  • Estate agents
  • Mortgage advisers
  • Other businesses operating within or supporting the property industry

Our services may include:

  • Executive search
  • Recruitment
  • Recruitment strategy
  • Interview and hiring support
  • Staff retention advice
  • Team restructuring
  • Recruitment process audits
  • Other property consultancy services agreed with the client

The precise services provided will depend on the requirements of each client and may be agreed separately.

2. OUR APPROACH TO RECRUITMENT

Property People Partners operates a targeted and selective recruitment approach.

We do not routinely provide large numbers of CVs for clients to review.

We take time to understand the client's business, the role, the requirements and the type of person who is likely to be a good fit.

We then proactively identify and approach individuals who we believe may be suitable.

Candidates may be actively seeking a new opportunity or may be approached on a confidential basis despite not actively looking for a new role.

The introduction of a candidate does not guarantee that the candidate will be suitable for the role or that an appointment will be made.

3. CLIENT INSTRUCTIONS

Before commencing a recruitment assignment, we will seek to understand the client's requirements, including where appropriate:

  • The nature of the role
  • Required skills and experience
  • Responsibilities
  • Salary and benefits
  • Location and working arrangements
  • Reporting structure
  • Business culture and requirements
  • Any other relevant information

Clients are responsible for providing accurate and complete information about the role and their organisation.

4. CANDIDATE INTRODUCTIONS

A candidate will be considered introduced to a client where Property People Partners provides information identifying the candidate to the client in connection with a potential role.

This may include a CV, professional profile, contact details or other information sufficient to identify the candidate.

If a client is already aware of or in contact with a candidate introduced by Property People Partners, the client should notify us promptly.

5. INTRODUCTION FEES

Where a candidate introduced by Property People Partners is subsequently employed or engaged by the client, an introduction or recruitment fee may become payable.

The applicable fee, payment terms and any replacement or guarantee arrangements will be agreed with the client before or at the commencement of the relevant assignment.

Unless otherwise agreed in writing, fees are calculated by reference to the candidate's remuneration package.

VAT will be charged where applicable.

6. PAYMENT

Invoices are payable within the period stated on the relevant invoice or agreed with the client.

If payment is not made by the due date, Property People Partners reserves the right to suspend further recruitment or consultancy services until the account is brought up to date.

We also reserve the right to charge interest on overdue amounts where permitted by law.

7. CANDIDATE INFORMATION

Information provided about candidates is supplied for the purpose of considering their suitability for a particular opportunity.

Clients must keep candidate information confidential and must not disclose, reproduce or use that information for any purpose other than assessing the candidate for the relevant opportunity without our prior agreement.

Clients must comply with applicable data protection legislation when handling candidate information.

8. CLIENT RESPONSIBILITIES

The client is responsible for:

  • Providing accurate information about vacancies and opportunities
  • Conducting appropriate interviews and assessments
  • Making appropriate employment checks
  • Obtaining references where required
  • Confirming the candidate's right to work
  • Making any necessary regulatory or professional checks
  • Ensuring that the proposed employment complies with applicable law
  • Making the final decision regarding appointment

Property People Partners may assist with elements of the recruitment process where specifically agreed, but the final decision to appoint remains with the client.

9. CANDIDATE RESPONSIBILITIES

Candidates are responsible for ensuring that information they provide to Property People Partners is accurate and complete.

Candidates must notify us if any material information changes during a recruitment process.

Property People Partners is not responsible for inaccuracies or omissions in information supplied by candidates.

10. RECRUITMENT PROCESS

Property People Partners will use reasonable care and skill in providing recruitment services.

However, we cannot guarantee:

  • That a suitable candidate will be identified
  • That a particular candidate will accept an opportunity
  • That a recruitment process will result in an appointment
  • That a candidate will remain employed for any particular period

Recruitment timelines may vary depending on the role, market conditions and availability of suitable candidates.

11. REPLACEMENT / GUARANTEE PERIOD

Where a replacement or guarantee period applies, the terms will be agreed with the client in writing before the relevant recruitment assignment commences.

Any replacement arrangement will be subject to the conditions agreed at that time.

Unless specifically agreed in writing, no replacement or refund obligation will apply.

12. CONSULTANCY SERVICES

Where Property People Partners provides consultancy services, the scope of work, fees and timescales will be agreed with the client.

Consultancy advice is provided based on the information available to us at the time.

The client remains responsible for decisions made as a result of any advice or recommendations provided.

13. CONFIDENTIALITY

Both Property People Partners and the client agree to keep confidential any commercially sensitive or confidential information received during the course of the relationship.

This obligation does not apply to information that:

  • Is already publicly available
  • Was already lawfully known to the receiving party
  • Becomes publicly available other than through a breach of confidentiality
  • Must be disclosed by law or a regulatory authority

14. DATA PROTECTION

Property People Partners will process personal information in accordance with applicable data protection legislation, including the UK GDPR and Data Protection Act 2018.

Clients are responsible for ensuring that their own processing of candidate and employee information complies with applicable data protection legislation.

15. LIMITATION OF LIABILITY

Property People Partners will provide its services with reasonable care and skill.

To the extent permitted by law, Property People Partners will not be liable for indirect or consequential losses arising from the recruitment or consultancy services provided.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

16. TERMINATION

Either party may terminate an ongoing recruitment or consultancy assignment by providing reasonable written notice, subject to any specific terms agreed for that assignment.

Termination will not affect any rights or fees that have already arisen before termination.

Where a candidate has been introduced before termination and is subsequently engaged by the client within an applicable introduction period, any agreed recruitment fee may remain payable.

17. CHANGES TO THESE TERMS

Property People Partners may update these Terms & Conditions from time to time.

The version applicable to a particular assignment will be the version agreed or in force when the assignment commenced, unless otherwise agreed in writing.

18. GOVERNING LAW

These Terms & Conditions are governed by the laws of England and Wales.

The courts of England and Wales will have exclusive jurisdiction in relation to any dispute arising from these Terms & Conditions, subject to any mandatory legal rights that apply.
